The Supreme Court has ruled 5-4 in favor of the Affordable Care Act.

In casting the deciding vote to uphold Obamacare, Chief Justice Roberts made a statement that he will return the court to its non-partisan roots. He has made a point to make a decision based on the rule of law instead of partisanship. Given the history of trading of votes within the Supreme Court for a sustainable decision, I do wonder if the Chief Justice encouraged Justice Kennedy to write the minority decision to change the perception of Justice Kennedy as the swing vote between two partisan factions. This again reinforces the idea that the Roberts Court will be known for turning the court away from a brief period of partisanship that started with Bush v Gore and came for an end today.

The vote split was a surprise to one of the laws architects Ezekiel Emanuel who expected a 6-3 vote to sustain or 5-4 vote to overturn.

I also wonder if President Obama watched coverage on CNN and first thought the Affordable Care Act was overturned. Clearly CNN was unprepared for the unusual method for reporting Supreme Court decisions. The fact that CNN got the biggest news story of the year wrong is an historic gaffe that fits the narrative of a network in decline. I don’t think the Piers Morgan interview with Rielle Hunter last night is enough to rebuild its brand or its ratings.
